Directory Listing Terms of Service

1. Introduction

These terms govern creating listings in our Service Provider Directory. By creating a listing, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not create your listing.

2. Intellectual Property Rights

This directory is the full intellectual property of Fix My Stupid PC! It may not be embedded in whole or in part, and you may not subvert our advertising within your lising. You may link directly to your listing only by using the full URL and any printouts of the listing that are posted or distributed must be printed via the printer-friendly format provided by the site component or with the full advertising intact.

Further, you grant the website full license to display your submitted creatives and trade name for the purpose of advertising your business via the listing and agree that this license shall remain in effect for the duration of the time that you publish said listing on the site.

3. Fees and Charges

This directory is provided free of charge as a community service. If your business has multiple locations, you may post a listing for each location, and if you are not sure how to do the geocoding to create the map you may contact us to do this for you.

Again, listing your business in the directory is completely free of charge.

However, if you wish the same listing (Same Address and Contact Information) to appear in multiple Cities or Metro Areas, you may select up to 5 additional locations for it to appear for a fee of USD $5 each remittable via PayPal.

This is to prevent the likelihood of scams and large service corporations creating blanket listings that eclipse smaller businesses which the site administrators see as unfair. If you are in an extremely rural area, this policy may be overlooked on a case-by-case basis. Please contact the administrators after you have created your listing with your additional locality request.

Furthermore, charging a business a fee to create a listing in our directory is not allowed and will not be tolerated. Anyone found to be doing so will be subject to legal action and fraud charges will be pressed unless this fee is in the form of salary or pay for normal business duties.

4. Limitations of Liability

This directory is provided free of charge and because you maintain the listing yourself you acknowledge that it would be unreasonable to hold us liable for the information contained therein.

Listings are subject to approval and editing for clarity and grammatical or geographical accuracy. Improper listings are subject to rejection or deletion, and listings that are linked to accounts that do not log into the website at least once every 90 days are subject to deletion.

You provide your contact information at your own risk. We take reasonable measures to protect your email address, including participating in Project Honeypot which tracks the IP addresses and user agents of known e-mail harvesting programs and rejects and redirects their connections Our content management system also attempts to use javascript for displaying email addresses. We will not be held liable for any contacts or threats you may receive.

You also agree that while customer reviews and ratings are subject to approval by the site administrators this is only for prevention of obvious spamming and defamation, and beyond this you acknowledge it is unreasonable to hold us liable for the comments and opinions of others as they are not our own.

Listings (Including paid duplicate listings) are provided (to the maximum extent of applicable law) exclusive of all representations, warranties, conditions (includint without limitation the conditions implied by law of satisfactory quality, fitness for purpose and the use of resonable care and skill.)

Our liability is limited and excluded to the minimum extent permitted under applicable liaw. We will not be liable for any direct or indirect loss, damage, or libel under these terms or conditions or in connection with your listing or any customer reviews or ratings posted therein, whether arising in tort, contract, or otherwise. Without limiting the generality of the forgoing exclusio, we will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue, or anticipated savings arising under terms and conditions or in connection with our directory, wether direct or inderect and whether arising in tort, contract, or otherwise. However, nothing in these terms and conditions shall exclude or limit our liability for any liability which cannot be excluded under applicable law.

5. Access Restrictions

Creation of Listings and posting of reviews and ratings is limited to registered and verified users of the website. Furthermore the use of CAPTCHA is required to prevent the creation of entries by computers.

6. Law and Jurisdiction

These terms and conditions will be governed by and construed in accordance with the laws of the City of Austin, Travis County, State of Texas, United States of America, and any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts thereof.
